Receiver Deactivation

Is the above receiver lawfully deactivated in compliunce with Federal ATFE regulations? Can it be legally purchased by a non-FFL (CL03) holder? I thought they had to be cut into three pieces and maybe by torch cuts. The seller appears to be parting out a complete MP40 and people are bidding on this thing. Maybe this is not the place to ask but I was curious and there is no Milsurps MG Forum. Hoping maybe M2 guys are savy on Fed Demil Regs. Thanks. ChipS

The ATF people have been waffling back and forth on just how it is supposed to be done for many years. ATF's standard now is torch cut into four pieces one being no more than one inch from the face of the chamber. And finally, one piece must be discarded or destroyed.

I believe that the requirement is that the receiver be torch cut into at least 4 pieces, with 1/4" of material removed at each cut. (See ATF P5300.4).

Until 1986, ATF would permit a manufacturer to weld & "re-activate" these torch cut demilled NFA guns. But, no longer. So, any such receiver would be worthless to the collector or shooter. While I am not aware of ATF seizing these demills, it's easy to see that simple possession, under the right circumstances, could get you into trouble. Never underestimate what a Supervisory FLEO will do to assure that he gets his merit pay bonus.
