    Question 03FFL question on shipping to 03FFL

    I live in the wonderful free state of Massachusetts, sarcasm intended.

    I am going to be selling one of my U.S.iconNavy marked S&W Victories. We have to "register" every purchase and sale in MA even to a dealer whether in state or out. That is pretty straight forward.

    the question I have, and I have an email in to BATFE about it, can I legally sell to and ship to a 03FFL in another state? They are not a dealer and I have been told by several people on Northeastshooters.com - Frontpage News that unless I ship a handgun directly to a 01FFL it is breaking the law.
    I can see where I can ship to a non-licensee so would think 03 to 03 would be fine, but living in Massachusettstan I don't want to take the chance.

    we have to fill out the sale paperwork and need to put the 01FFL's number on the paperwork and since an 03 has a number I would think that would be ok, but I don't look good in stripes, or orange.

    I agree, we are allowed to sell 4 guns a year in Mass, buy hundreds but only sell 4. However if we go through a dealer or sell to an out of state dealer we can sell as many as we want. Selling to an out of state dealer the paperwork is easy.
    Selling through a dealer in Mass most charge 20% of the sale. I did that with my Bushmaster and an Armi Jaeger AP74, but want to put some C&R guns up for a good price and they may take a while to sell and most dealers don't want to do that, it is all about turnover (as well as the 20% commission).

    I am pretty sure that I can send to a 03 (03 to 03) but want to be sure.

    Don't know what the Mass. state laws say, but per Fed. law, you can ship any C&R fireaem directly to a (proven) C&R licensee. HTH.

    You can NOT ship to a C&R (FFL03) in New Jersey , only a N.J. state licensed dealer. State law since 1966 (pre 1968 Gun Control Law). That is why the CMPicon can not ship to the buyer in N.J.

    State law will override Federal if stricter. Get a copy of the "State Laws and Published Ordinances - Firearms" from BATFE and research the receiving state's laws before you do anything.

    Talked to Criminal History Records, Firearms Record Board, I love how our gun registrations are addressed to the Criminal History Records.

    Anyhow they said that in state I cannot sell to an 03, I sell to their State License, which is fine, you are allowed to sell 4 a year then you have to go through an 01 dealer.

    Interstate I can ship to an 03FFL since they have a Federal License I can write that down on the form as the buyer, but it has to be done on the paper FA10 registration form. so it is the same as shipping to an 01FFL interstate.
