The Second Amendment does not apply within States and municipalities. It applies only at the Federal level so says the court. Power to the tyrannts. WTF?

The logic is down right stupid. Does this ruling mean that all other federal constitutional ammendments are unconstitutional? The 1st,3rd, 4th etc. The states don't have obey the federal constitution?

1. This was a three-man appeals court. Expect it to be appealed to SCOTUS by the NRA or some other group.
2. What they are doing is simply denying the 14th amendment "Incorporation" doctrine that has been accepted by the SCOTUS for 120 years to guarantee that the freedoms in the Bill of Rights are protected in all subordinate courts and legislative bodies. It's a favorite of the left, in fact, applying all Bill of Rights-based strictures levied against the congress downward on all other governing bodies. To selectively deny Incorporation on this one amendment is clearly wrong and most likely won't survive a SCOTUS challenge. By the way, Sonia Sotomayor interprets local application of the 2nd Amendment (and it only) in the same way, by going back prior to 1880 for her proof and ignoring the 120 years of precident. Guys, guys, guys.... calm down.... This is actually necessary and is the right step. The Heller case as onlya thinly defined victory - everyone (including the Supreme Court Justice) knew that the Heller case was only the opening shot. What this Appeals court decision does is FORCES the gun issue back to the Supreme Court - and it does so on VERY friendly grounds to the gun people. Let's see... the Supreme Court is going to rule that the Constitution does not apply to the States???????? This is a set-up. Heller was a weak case that even the NRA tried to dump... think about what we are going to win out of this one!!! Yea, the gun forums are all shocked, but why are the Liberals not cheering over this decision right now? They can read the handwriting on the walls!!! Even with a 5-4 vote, this is TOO easy!!!!

The new nominee will change nothing on the court (unless) she can be very convincing to the others, unlikely. Its an even exchange--liberal for liberal. 60 % of nominee's majority opinions have been reversed by higher courts, not a good record!
