MP40 Receiver Deactivation
RARE ORIGINAL SAW CUT WWII MP40 DEMILLED RECEIVER : Class 3 Parts & Accessories at GunBroker.com
Is the above receiver lawfully deactivated in compliunce with Federal ATFE regulations? Can it be legally purchased by a non-FFL (CL03) holder? I thought they had to be cut into three pieces and maybe by torch cuts. The seller appears to be parting out an complete MP40 and people are bidding on this thing. Maybe this is not the place to ask but I was curious and there is no MG Forum. Thanks. ChipS

I would not have placed any bid on this puppy! No way! ATF, torch cut, 1/4" cuts, four pieces, with one cut one inch from chamber face and one piece destroyed or discarded.

Thanks, Bill. That is pretty much what I thought. I have always wanted to build a Sten but if I do it I will want to do it right - legal receiver, Class 03 builder, taxed and registered. I just didn't know if this type of cutting somehow was within current ATFE regs. ChipS

First off , no new MGs can be made after '86 for us peons . Dealer samples only . SBR semi-auto copies are still permitted.
Second , guns that are cut up by the rules in effect at the time of destruction are legal. There is no requirement to update the destruction as rules change . Many older demills bring more money because they are easier to restore to semi-autos or dealer samples .
So , if the above was a proper demill at one time and the gun existed at that time , it could be legal .

Sten and Sterling tubes registered prior to the May '86 ban can still be had from DLO in Florida as far as I know if you want to do a build. However, you might be better off just buying a registered gun on a F4 at the price. There's no real cost savings anymore to build one as you'll invest as much or more in it than just buying a transferable gun outright. There are plenty of Stens out there for sale that are transferable. Food for thought.

They are all gone... hence the jump in price.
Some guy in Texas bought the Sterling tube.

No.
Even back when saw cutting was legal, there had to be three cuts.
