    September 1, 1935

    IN REPLY REFER TO:

    SUBJECT: Stolen Rifle.

    TO: The Adjutant General of the State.

    1. In compliance with Par. 11, NGR 75-3, I hereby report the loss of a U.S. Rifle # 34230 Springfield. This rifle was stolen in Rome, N.Y., the company having participated in a parade in conjuction [sic] with the balance of the 3rd. Bat. 10th. Inf. for the D.A.V. convention.

    2. Investigation shows that the company truck was to go to Y.M.C.A. to collect the rifles, but because of traffic was unable to get through in time so the Company was marched to rear of Rome Armory where cars were parked.

    3. 1st Lt. Schultz in command of the Company instructed the members to wait for the return of the truck and place their rifles thereon. At this time it was raining and the men on being dismissed went to their cars for shelter.

    4. Pvt. Sam P. Lahey was one of the men who went to their cars for shelter and thought it would be safe to leave his rifle in his car, so he placed it in compartment in rear of the seat in a convertable [sic] coupe and on leaving locked the doors of the car.

    5. On returning to his car at 10:30 P.M. to leave, he looked to make sure rifle was safe and found that it had been stolen Several articles including army raincoats on the seat were not touched but the flap on the back of the car was opened. The loss was not reported until arrival back at the Mohawk Armory when such was reported to Sgt. Peter E. Smith.

    6. Loss has been repoted [sic] to Chiee [sic] of Police at Rome, N.Y. also the State Police.
